Smart Sourcing Aluminum Extrusions: Merchandise from Canada Containing Aluminum Extrusions

In the Spring of 2024, the International Trade Administration and Customs and Border Protection extended Antidumping and Countervailing duties on aluminum extrusions from over a dozen additional countries, and the trend of increasing regulation shows no sign of slowing.  Subsequent “third country cases” over the summer have been put in place specifically to identify merchandise being imported into the United States and made in Canada that contain aluminum extrusions with a “Country of Extrusion” that is subject to existing antidumping and countervailing orders.  

While aluminum extruded in Canada and articles containing aluminum extruded in Canada are not subject to antidumping and countervailing duties upon US import (for now), these new third country cases specifically target articles with a country of origin of Canada that contain aluminum extrusions produced in one of the other countries subject to antidumping and/or countervailing regulations. Five cases are currently in place, and likely more will be instituted unless there is a change of current trends:

A-122-996  ; parent principal case - A-552-837; COO VN; 06/14/2024

A-122-995 ;  parent principal case  A-557-826; COO MY; 06/14/2024

A-122-158 , C-122-159 ; parent principal case A-570-158 and C-570-159; COO CN 05/29/2024

A-122-870; parent principal case A-475-846; COO IT ;  08/22/2024

The additional ad valorum rates on these cases range from 15.30% (A-122-870) to 376.85% (A-122-158). Consequently, US importers could find their business critically impacted if their imported merchandise entails aluminum extrusions or articles containing aluminum extrusions sourced from any of these regulated countries: Vietnam, Malaysia, China, or Italy – even if the merchandise was produced or manufactured in in Canada.

With the country of origin of merchandise no longer representing an authoritative indicator of its vulnerability to antidumping and countervailing duties on aluminum extrusions, the onus has never been higher for importers to be self-conscious about the sourcing of aluminum extrusions within their supply chains.
