De Minimis Shipment Regulation Delayed

US President Trump delayed the tariff order that would prevent shipments worth $800 or less to be entered into the United States duty-free. The “de minimis” exemption allows duties and fees to be waived when the value of a shipment is less than $800, as described in Section 321 of the Tariff Act of 1930. De minimis shipments have been previously justified as noting that the collection of duties and fees may be more work than they are profitable. With the increase in e-commerce,  

The President signed the executive order on February 1st to block the de minimis treatment to target the Chinese and Hong Kong e-commerce industries, including companies like Shein and Temu, who account for nearly half of all de minimis shipments into the United States.  

On Friday, February 7th, President Trump paused the administrations repeal of the duty-free treatment to allow the Department of Commerce to create a gameplan for handling the order. The Department of Commerce will have to account for more than 1 billion low value e-commerce packages annually into the United States and determine the most efficient way to collect duties and fees.
