USTR Opens New Section 301 Tariff Investigations

The Trump administration is opening a new round of trade investigations that could support additional import tariffs, after the Supreme Court last month overturned certain earlier tariff actions. On March 11, the Office of the U.S. Trade Representative (USTR) initiated Section 301 investigations focused on what it calls “structural excess capacity” in a range of manufacturing sectors. 

The inquiries target the acts, policies, and practices of Bangladesh, Cambodia, China, the European Union, India, Indonesia, Japan, Malaysia, Mexico, Norway, Singapore, South Korea, Switzerland, Taiwan, Thailand, and Vietnam. 

Per the USTR, overproduction abroad can “displace existing U.S. domestic production” and discourage investment that might otherwise expand U.S. manufacturing capacity. 

Potentially affected industries include aluminum, autos, batteries, cement, chemicals, electronics, energy goods, glass, machinery and machine tools, non-ferrous metals, paper, plastics, processed foods and beverages, robotics, satellites, semiconductors, ships, solar modules, steel, and other transportation equipment. 

The investigations points to the partners’ “large or persistent trade surpluses” with the United States as a key indicator of excess capacity.  

Public comment on these investigations will be accepted between March 17 and April 15 with a hearing held on May 5. The USTR hopes to conclude the investigations before Section 122 tariffs expire on July 24.
