Temporary Stay on CIT Section 122 Decision
On May 7, 2026, the U.S. Court of International Trade (CIT) ruled that the Section 122 tariffs, implemented as a replacement for the IEEPA tariffs, were imposed unlawfully. However, on May 12, the U.S. Court of Appeals issued a temporary stay of the CIT’s decision.
The stay pauses the May 7 ruling to allow for further review, effectively removing the Section 122 relief previously granted to affected businesses and to Washington State. This temporary pause gives the federal government additional time to prepare its response to the CIT’s findings and, as with the earlier IEEPA tariff litigation, the matter could ultimately reach the Supreme Court of the United States.
Section 122 tariffs are currently set to expire in July, though they may be extended with congressional approval.
