New Global Tariffs imposed after Section 122 Tariffs Expired

As of July 24, the Office of the United States Trade Representative has imposed new tariffs of 10% or 12.5% (see breakdown below) under Section 301 of the Trade Act of 1974. These tariffs follow the expiration of the temporary 10% Section 122 tariffs on July 24th at 12:01 am. Both the Section 301 and 122 tariffs come after the U.S. Supreme Court struck down the IEEPA tariffs earlier this year. The new Section 301 tariffs apply to 60 countries identified in a forced labor investigation, including whether they have and enforce laws regulating forced labor.

The forced labor investigation resulted in the following countries being tariffed accordingly:

  1. 10% tariff on products from Argentina, Bangladesh, Cambodia, Canada, Ecuador, El Salvador, Guatemala, Honduras, India, Indonesia, Jordan, Malaysia, Mexico, Pakistan, Sri Lanka, Trinidad and Tobago, and the United Kingdom
  2. a 10% or 12.5% on certain products from European Union, Taiwan, Japan, Korea, and Switzerland
  3. 12.5% on other countries pursuant to investigation

There are certain articles that are exempt from these tariffs. The exemptions generally apply to articles for which tariffs would adversely impact the U.S. economy or are unlikely to meaningfully advance the underlying policy objectives. These articles can be identified in Annex’s I and II of the Federal Register Notice.
