New Duty-Relieving HTS Announced for Section 232 Aluminum, Steel, and Copper

On April 27, 2026, the Department of Commerce issued a notice in the federal register noting some additions to the Section 232 aluminum, steel, and copper tariffs that took affect on April 6, 2026:

While the second and third of these corrections clarify inconsistency, the first correction is very pertinent to US import transactions, as it prescribes a new subheading in Chapter 99 of the HTSUS – HTS 9903.82.01, which provides for aluminum, steel, or copper articles or their derivatives that do not actually contain any of those metals.

Effective retroactively from April 6, 2026, business should report 9903.82.01 on imported merchandise that would otherwise be subject to one of the 50% or 25% Section 232 tariffs against steel, aluminum, or copper if the merchandise in question doesn’t actually contain any content of those respective metals. This new requirement ensures imported merchandise not containing aluminum, steel or metal will not be subject to the associated 232 duties against those metal items, and importers should review their relevant import transactions back through April 6 and correct them with customs in order to ensure compliant reporting and a potential refund on overpayment of duties.
