Take to the Skies

The Washington Department of Revenue has amended Wash. Admin. Code §  458-20-265 (Sales and use tax exemption—Airplane maintenance repair stations) effective February 24, 2024. The amendments incorporate changes made by L. 2023, H1318, which expands the sales and use tax exemption for payments made by an eligible maintenance repair operator for the construction of a new building and related machinery and equipment. The Department may not refund the state sales and use tax unless the purchaser reports at least 100 average employment positions to the Employment Security Department for the four consecutive calendar quarters, beginning with the first calendar quarter after the date the facility is issued an occupancy permit by the local permit issuing authority, with average annualized wages of $80,000.

 

Revised State’s Nexus Threshold for 2024

  • Louisiana
    • Effective August 1, 2023, the threshold is $100,000 in gross revenue. Until July 31, 2023, the threshold was $100,000 in gross revenue or 200 separate transactions.
  • Missouri
    • Effective January 1, 2023, use tax will be collected from out-of-state retailers who sell and deliver more than $100,000 in tangible goods to consumers in Missouri annually.
  • South Dakota
    • Threshold: Over $100,000 in sales or, until July 1, 2023, over 200 sales transactions, in the previous or current calendar year.
