Forced Labor Prevention Act

Are you ready for the Uyghur Forced Labor Prevention Act (UFLPA) that goes into effect on June 21st, 2022? The UFLPA states that goods manufactured wholly or in part in the Xinjiang Uyghur Autonomous Region of the People’s Republic of China could be prohibited entry into the U.S. This is based on the Xinjiang region having many industries that use forced labor, and moving forward all items will be presumed, in whole or in part, to be produced with forced labor.

This being the case, the importer will have the burden of proof to show that the goods were not made, mined, or produced in whole or in part with forced labor.  This could require, among other things, the mapping of the supply chain and implementation of supplier codes of conducts.

On June 13, 2022, CBP posted guidance on how importers may request exceptions to the rebuttable presumption clause in UFLPA. This will tell the importer what CBP will need in order to grant an exception on a case-by-case basis.
