Federal Appeals Court Allows 122 Tariffs To Continue
On June 11, the U.S. Court of Appeals for the Federal Circuit ruled in favor of the Trump administration, allowing the continued collection of the 10% Section 122 tariffs while litigation brought by a coalition of U.S. states and small businesses proceeds.
The Section 122 tariffs were implemented by the Trump administration in February following a U.S. Supreme Court decision that found the IEEPA tariffs to be unlawful. The Section 122 tariffs are currently scheduled to expire on July 24.
The court also noted that, should the tariffs ultimately be found unlawful, the availability of refunds with interest would mitigate any harm caused by the payment of duties or delays in receiving refunds.
