EU Importers: Take Advantage of the New EU–US Preferential Tariff Rates

Since July 1, 2026, the European Union has introduced a new preferential tariff regime covering a wide range of products originating in the United States. This development offers EU importers a valuable opportunity to reduce their import costs, provided they fully comply with the applicable customs requirements.

 Preferential Tariff Benefits Worth Exploring

Under the new regime:

  • 0% customs duties apply to numerous product categories.

  • Tariff Rate Quotas (TRQs) are available for certain sensitive products.

These measures can significantly enhance the competitiveness of importing businesses. However, access to these preferential rates is not automatic.

Origin: The Key Eligibility Requirement

To benefit from the preferential treatment, importers must be able to demonstrate that their goods qualify as originating in the United States in accordance with the Union Customs Code (UCC).

Origin can be established under one of the following criteria:

  • Wholly Obtained: the product is entirely obtained or produced in the United States.

  • Last Substantial Transformation: the final substantial and economically justified transformation took place in the United States, resulting either in a change in tariff classification or in the creation of a new product.

Without robust evidence of US origin, preferential tariff treatment cannot be granted.

Key Actions for Importers

To fully benefit from these new measures, importers should take the following steps

1. Review Your HS/CN Classifications

2. Compare your US-origin products against Annexes I, II and III of Regulation (EU) 2026/1455 to determine:

  • products eligible for a 0% customs duty

  • products subject to a Tariff Rate Quota (TRQ)

  • products that are not eligible for preferential treatment

3. Audit Your Origin Documentation

Ensure that you can substantiate US origin by reviewing:

  • manufacturing processes

  • the location of each production and processing stage

  • the completeness and consistency of all supporting documentation

4. Align Your Customs Procedures

Work closely with your customs broker or customs representative to update:

  • the applicable preferential customs codes

  • TRQ management procedures

  • the documentation required to support preferential claims

Be Aware of the Risks of Non-Compliance

Incorrect application of the preferential regime may result in significant financial and operational consequences. Customs authorities may impose:

  • denial of preferential tariff treatment

  • retroactive collection of customs duties

  • Financial penalties

  • increased customs audits and compliance inspections

The new EU preferential tariff rates for US-origin products represent a strategic opportunity for European importers to reduce costs and strengthen their competitiveness. However, realizing these benefits requires strict compliance with the Union Customs Code, robust origin documentation, and well-aligned customs procedures. By preparing proactively, businesses can secure the available tariff advantages while minimizing the risk of customs reassessments and penalties.
