CIT directs CBP to Reliquidate Certain Entries

The U.S. Court of International Trade (CIT) on July 15 issued an order directing U.S. Customs and Border Protection (CBP) to reliquidate certain finally liquidated entries as part of Phase 3 of the ongoing processing of IEEPA refunds through CAPE.

As this order will only apply to related cases before the court importers may want to consider filing suit at the CIT. Filing suit will help ensure refunds of entries that have been liquidated more than 80 days.

Phase 3, which will be deployed later this month, will provide refunds for those liquidated entries that are before the court.

Additionally, CBP is developing CAPE functionality to process refunds for entries with open protests.

If an importer does not wish to file a lawsuit, they should consider filing protests on any liquidated entries (if within the 180 day window) to preserve your legal rights to the refunds.

CBP is scheduled to provide the court with its next CAPE implementation update on August 14.
