CBP Announces October 6 Deployment of CAPE Phase 3

U.S. Customs and Border Protection (CBP) will deploy Phase 3 of the Consolidated Administration and Process of Entries (CAPE) in the Automated Commercial Environment (ACE) on October 6, 2026. According to a CBP Executive, Phase 3 will address finally liquidated entries for which the CIT has ordered reliquidation in connection with the IEEPA tariff litigation.

Participation is strictly restricted to plaintiffs who filed individual lawsuits at the CIT and submitted a valid Importer of Record (IOR) number by July 30, 2026. CBP indicated that plaintiffs who provided their IOR number after July 30 will receive additional instructions regarding the Phase 3 process.

Overall, as of September 11, 2026, approximately 27.2 million IEEPA entries have been processed through CAPE, representing approximately $134.7 billion refunds.

CBP also reported that refunds totaling approximately $1.3 billion remained pending transmission because the required Automated Clearing House (ACH) account information had not been provided by the importer of record or its authorized CBP Form 4811 designee.
