CAPE Phase III Delayed

CBP advised the U.S. Court of International Trade (CIT) on Aug. 25 that, as of Aug. 21, it had processed approximately 26.4 million entries through its CAPE program since launch, accounting for $132.5 billion in potential and certified IEEPA duty refunds.

The agency also reported that 22,170 refunds totaling approximately $1.7 billion have not yet been transmitted to Treasury because importers of record or their authorized CBP Form 4811 designees have not provided the required ACH banking information.

The update also shows that approximately 2.3 million reconciliation-flagged entries have been successfully filed and are awaiting processing under expanded CAPE functionality deployed June 29. The functionality applies only to entries flagged for reconciliation where no Reconciliation Entry (Entry Type 09) has been filed. Entries for which a reconciliation has already been filed are expected to be addressed in a future phase of CAPE.

The agency also announced a temporary delay in the deployment of CAPE Phase 3, which covers finally liquidated entries subject to court-ordered reliquidation, while it develops additional validations to prevent unintended duty adjustments and address improper reporting of IEEPA duties on original entries. CBP emphasized that the delay affects only Phase 3 and that CAPE Phases 1 and 2 remain fully operational.

With multiple CAPE phases now underway and additional functionality still in development, many importers may have questions regarding refund eligibility, reconciliation entries, and the status of potential IEEPA duty recoveries. Importers seeking assistance in understanding how the various CAPE phases may affect their refunds, identifying available recovery opportunities, or navigating CAPE requirements can contact Allyn International at sales@allynintl.com for additional information.
