BIS Proposes Additional 232 Derivative Articles

On August 4, 2026, the Bureau of Industry and Security (BIS) published a proposal to expand the scope of Section 232 tariffs to include 14 additional derivative steel, aluminum, and copper articles. This is not notice of immediate changes being implemented, and the affected products are not yet subject to additional Section 232 duties. BIS is currently seeking public comment feedback before taking further action.

If ultimately adopted, the proposed products would become subject to an additional 25% Section 232 tariff. Based on the rationale outlined in the notice, the proposal is likely to move forward, with BIS citing the foreign affairs and national security exception under 5 U.S.C. § 553(a)(1). The notice emphasizes that steel, aluminum, and copper are critical inputs for the production of U.S. weapons systems and defense-related manufacturing, making these materials important to U.S. national security.

The list of potentially affected items and HTS codes are listed below:

  1. Aluminum powder of a non-lamellar structure
    • 7603.10.0000

    • Oxygen (2804.40.0000)
    • Propene (propylene) (2901.22.0000)

Importers of the above products should closely monitor developments and consider submitting comments during the public comment period. While the proposal is not yet effective, companies importing these products should assess potential duty exposure and supply chain impacts should BIS proceed with implementation.
