338 Tariffs on Canadian Products Postponed Three Days

President Donald Trump announced on Aug. 18 that he would pause the 50% Section 338 tariffs on an array of Canadian products for three days while the U.S. and Canada continue their trade negotiations. The tariffs were initially scheduled to take effect on Wednesday, Aug. 19, at 12:01 a.m. ET.

President Trump originally said he would impose the 50% ad valorem duty, under Section 338 of the Trade Act of 1930, on certain products of Canada, effective 12:01 a.m. ET on Aug. 19, in response to Canada’s tariff-rate quotas for dairy products.

The new effective date of the additional ad valorem duties is now 12:01 a.m. ET on Aug. 22.

The impacted Canadian goods and HTS numbers can be found in the annexes of the three proclamations listed below.

  • “Imposing Additional Duties to Offset Canadian Discrimination Against the Commerce of the United States With Respect to Dairy,” Annex I and Annex II.

  • “Imposing Additional Duties to Offset Canadian Discrimination Against the Commerce of the United States With Respect to Alcoholic Beverages,” Annex I and Annex II.

  • “Imposing Additional Duties to Offset Canadian Discrimination Against the Commerce of the United States With Respect to Motor Vehicles,” Annex I and Annex II.
