2017 Pennsylvania Tax Amnesty Program

The Pennsylvania Department of Revenue has announced a Tax Amnesty Program that will be offered from April 21 to June 19, 2017.  This program assures participants that half of any applicable interest and all penalties will be waived.  This program offers the opportunity for taxpayers to resolve tax related liability or delinquency. 

Those eligible to participate in the program include businesses which have non-filed state tax returns or reporting or under-reported filings as of December 31, 2015.  The amnesty applies whether the above noted delinquencies are known or unknown by the Department of Revenue.  Any who participated in the 2010 Tax Amnesty Program are not eligible to participate in the 2017 program.

Notices will be mailed by the Department of Revenue to those taxpayers with known delinquencies along with program application instructions.  Those notified and who choose not to participate may be subject to a 5% non-participation penalty, which would be added to any current balance due.

The list of eligible taxes is long and includes sales and use tax, hotel occupancy tax, gross receipts tax, agriculture cooperative tax, fuel use tax and employer withholding tax among others.  The program is not applicable to taxes administered by another state or local government, the federal government or by the Internal Revenue Service.

Stay current with your state, county, and city legislation. Conduct regular internal audits to verify all necessary returns have been filed and paid in full.  Periodically review your business activities including new locations, new products and your physical presence in each state.  A nexus review may be valuable in verifying if you are registered for sales and use tax in all required states.
