2015 Louisiana Tax Amnesty

A tax amnesty program is being offered by the Louisiana Department of Revenue during the period of November 16, 2015 through December 15, 2015.  The Louisiana Tax Delinquency Amnesty Act of 2013 allows eligible taxpayers to qualify for the amnesty program.  The press release issued November 3, 2015 by the Louisiana Department of Revenue indicates an amnesty will not be offered again for at least 10 years.  The 2015 Louisiana tax amnesty program is anticipated to collect an estimated $50,000,000.

This amnesty provides an opportunity for delinquent taxpayers (businesses and individuals) to clear unpaid tax bills and file past due state returns.  Eligible taxpayers include those who have failed to file a tax return, failed to report all income, tax, interest or penalties; claimed incorrect credits or deductions and some who may be currently under audit or judicial litigation.  Motor fuel taxes are not included in the amnesty program.

Letters have been issued to eligible taxpayers detailing how they can participate in the program. Electronic lump sum or installment payment agreements are being offered in an effort to create a simple reporting and remitting process.  As part of the amnesty agreement, accounts can be settled by paying 100% of delinquent taxes, 83% of the remaining interest charges, and 67% of the remaining penalties due. 

As the amnesty is available to taxpayers for only 30 days, businesses and individuals should review their operations and tax reporting in Louisiana to determine if they can benefit from this provision.  Additional information can be obtained by calling the Louisiana Department of Revenue at 1-866-782-9241, and applications are being accepted by the Louisiana Department of Revenue online at www.ldrtaxamnesty.com.

Review your operations, business presence, and tax return filings for the past few years to evaluate if there is value in taking advantage of this tax amnesty program.  Reduced penalties and interest charges are being offered by the Louisiana Department of Revenue.
